All purchases made through the official website Gerardo Sacco S.r.l. are governed by the general conditions of sale indicated below, in accordance with the provisions of the civil code, by Legislative Decree n. 206/2005, the so-called Consumer Code, and by the privacy legislation, Legislative Decree. n. 196/2003, as amended by the EU General Data Protection Regulation – GDPR – n. 2016/679.
1. GENERAL CONDITIONS
The terms of sale, delivery and payment are indicated in detail in the various sections of the website, moreover they are specifically reproposed during checkout and they are to be considered as essential and integral conditions of the sale contract.
The conditions to be applied to each individual order are provided to the customer in detail on the website at the time of the order.
Any change to contractual conditions and/or promotions will be applied only when they will be published on the website and to sales subsequently concluded with the modalities specified from time to time.
2. PURCHASE AGREEMENT
All purchases made through the official website of Gerardo Sacco S.r.l., concerning the available products and the relative prices indicated, constitute telematic contracts falling within the scope of the public offer, governed by art. 1336 of the civil code and following.
Every detail, method, option and / or limitation relating to purchases that can be made through this Site are expressly specified in these sale conditions, as well as in the summary that will be automatically sent to each buyer via e-mail to the e-mail address indicated, immediately after the conclusion of the purchase.
The essential characteristics of the products are described on the site within each product sheet. It should be noted that the images and colors of the products offered for sale may not correspond to the real ones due to the Internet browser and monitor used.
4. PRODUCTS NOT AVAILABLE AND PURCHASE RESTRICTIONS
The Gerardo Sacco company will be in any way responsible for the temporary or permanent unavailability of one or more products. In case of unavailability, even temporary, of the requested products, Gerardo Sacco & C. S.r.l. is committed to promptly inform the Customer in the manner provided by art. 54 of Legislative Decree. 206/2005 without charging the customer with the corresponding price or, in the case of advance payment, reimbursing the customer for the purchase if requested.
The prices of the products on sale, clearly visible to the Users in the appropriate sections of the product data sheet, are inclusive of VAT.
The price does not include the costs of the delivery service and any customs taxes for shipments to countries outside the European Union, to be considered as responsibility of the buyer.
The price calculated at the time of the order will not take into consideration any price increases or decreases, for promotions occurred later or previously concluded with respect to the time of purchase.
Payment can be settled, at Customer’s best convenience, in the following ways:
- Credit card
- Bank transfer
In the event that the Customer has expressed a preference for the bank transfer method, the reference number of the purchase order must be indicated in the purpose of the transfer. Once the order and payment by bank transfer have been placed, Gerardo Sacco S.r.l. will proceed with the order fulfillment only after the actual receipt of the relative payment.
If the payment is not credited to the company’s account within seven (7) working days after having placed the order, it will be canceled and, therefore, considered resolved pursuant to art. 1456 of the civil code.
If the sum relating to the purchase is only partially credited, the company Gerardo Sacco will suspend the execution of the shipment of the goods until the full payment of the order and in any case, no later than seven (7) days from the partial crediting.
It should be noted that some banking institutions may charge commissions for bank transfer transactions which do not in any way concern the company Gerardo Sacco S.r.l.
At the express request of the customer, an invoice will be issued based on the data provided while ordering online and a copy will be included in the package containing the Customer’s purchase, as well as a copy in PDF format that will be sent by e-mail to the Customer.
8. ORDERS ACCEPTANCE
Orders are effective and binding only by the moment when the entire purchase procedure is completed regularly. Otherwise, error messages will be visible on the Site screen which will invite the Customer to amend the incorrect data or to enter the missing ones. Gerardo Sacco & C. S.r.l. processes only orders completed in the correct manner and related to products expressly ordered by the Customer.
9. ORDER CONFIRMATION
As soon as the purchase is completed with the modalities indicated in the previous articles, the Customer will receive the order confirmation placed by e-mail to his e-mail address indicated during the purchase. In this communication, the Customer will be able to view the summary of the products purchased, their prices and the general and particular conditions applicable to the order.
10. ORDER PREPARATION
Generally, orders are processed within three (3) days by the time the payment is actually credited. However, times can be determined differently depending on the type of item, standard or customized, as indicated below:
- standard: 2 working days – from payment receipt;
- personalized, custom: 7 working days – from payment receipt;
- personalized, Mediterranean category: 30 working days – from payment receipt.
Delivery times are determined by the products preparation times, as indicated in the previous art. 10, and by the destination place.
- National 3-4 working days
- EU / UK / Switzerland: 4-5 working days
- USA / Canada: 5-6 working days
- Australia: 8 working days
Gerardo Sacco & C. will not be responsible for any delays due to the transport service or anomalies of the products not attributable to factory defects or improper handling of the products by the seller.
To protect customers, the Gerardo Sacco company invites you to refuse delivery or or accept it with reserve in case the package is visibly damaged or has anomalies.
Any disputes related to the execution of the service may be raised, subject of revocation, within ten (10) days of delivery, by contacting the customer service of Gerardo Sacco S.r.l. at the address: email@example.com.
12. DELIVERY FAILURE
The presence of the Customer or his representative is required at the address indicated in the order for the delivery to be made. Gerardo Sacco & C will also have the right to exclude the customer from subsequent purchases or to make the provision of the service subject to online payment.
13. RIGHT OF WITHDRAWAL
This Regulation is based on the rules of the Consumer Code, Legislative Decree no. 206/2005.
Within fourteen (14) days from the date of delivery of the goods, the Customer has the right to withdraw from the contract, even partially in case of orders related to several products, without providing any reasons and without additional costs, provided that the withdrawal is communicated and approved through the return procedure indicated below.
- Access the “Order History” section from “My Account”;
- Select the order from which you want to return an item by clicking on “Details”;
- Select the products you want to return through the box next to the names;
- Add the quantity to be returned (in case more than one product needs to be returned);
- In the “Returning Goods” section, add an explanation, so that the team better understand why the customer wants to return that product (Optional);
- Click on “Send Return Request”;
- View the status of the request from the “My Returns” section of “My Account”;
- When the status changes from “Waiting for confirmation” to “Waiting for the package”, download and attach the “Return Form” inside the package;
- Send the package at your own expense to the address indicated on the “Return Form”.
If the return procedure has been exercised in accordance with the methods described, the status of the request, which can be viewed in the Customer’s “personal area” section of the site, will change from “Package received” to “Return completed” and Gerardo Sacco & C. S.r.l. will refund the amount paid for the purchase of the product as soon as possible and in any case within 14 days.
The right of return cannot be exercised for customized products, pursuant to the provisions of art. 59 of the Consumer Code.
Gerardo Sacco & C. S.r.l. guarantees compliance with the quality standards relating to each product, with the seriousness with it has been operating for over sixty years in the Made in Italy luxury sector.
As specified in the previous art. 11, any liability relating to the bad condition of the products due to improper handling after the order delivery to the carrier is excluded.
The Gerardo Sacco S.r.l. company disclaims any liability for direct or indirect, actual or potential damages, of any nature and in any form, resulting from the use of the company’s official website overall and / or the news, photos, images and information contained therein.
Gerardo Sacco & C. S.r.l. will proceed to the processing of the Customer’s personal data in full compliance with national and international privacy legislation, as specified in detail in the information in the “Privacy” section of the Site.
For any dispute that may arise in relation to the application, interpretation and execution of these general sale conditions, the Court of Crotone will be absolutely competent.
